💬 How much does a family lawyer in Hurstville cost?

💬 Do I need to be separated for 12 months before filing for divorce?
Yes. Under Australian law, you must be separated for at least 12 months before applying for a divorce. In some cases, you can still live under the same roof and be considered separated, but you’ll need to provide extra evidence. However, you do not need to wait for a divorce to put arrangements in place for your children or divide your assets.

💬 What if my ex-partner won’t agree to a property settlement?
If negotiation or mediation fails, we can apply to the Family Court or Federal Circuit Court to obtain a binding property settlement Order. Our goal is always to resolve matters outside of court first to save you time and costs.

The Court considers the best interests of the children above all else, including safety, but maintaining relationships with both parents where appropriate.

💬 Can grandparents apply for parenting orders?
Yes. Under the Family Law Act, grandparents and other relatives can apply for parenting orders if it is in the child’s best interests.

💬 What is a binding financial agreement (BFA)?
A BFA, sometimes called a “pre-nup” or “post-nup,” is a legally binding contract that sets out how assets and finances will be divided if a relationship ends. We can prepare or review BFAs for married and de facto couples.

💬 Is mediation required before going to court for parenting matters?
In most cases, yes. Before you can apply to the Court, you will need to attempt mediation and obtain a Section 60I certificate unless there are urgent or exceptional circumstances (such as domestic violence).

You must apply within 12 months of your divorce being finalised. For de facto couples, the time limit is 2 years from the date of separation.
